Terms and Conditions of Use

  1. Introduction

1.1. Overview: These terms and conditions govern the use of Maidah App (referred to as “the App”), provided by Maidah App Limited. By accessing or using the App, users confirm that they have read the Privacy Notice and agree to comply with the terms and conditions herein. If you do not agree to any of these Terms, you must not use the Service.

1.2. These terms constitute an agreement between Maidah App Limited, the owner and operator of www.maidahapp.com (the Site) and Maidah App (the App), and you (you), a user of the service.

1.3. Supplemental terms and conditions may be posted from time to time and will be updated here accordingly. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms from time to time. We will alert you about any changes by updating the ‘Last Updated’ date of these Legal Terms. Please ensure that you review these terms periodically to stay informed of updates.

  1. The Service

Maidah App is a centralised halal food and loyalty app in the UK, helping customers to discover restaurants and gain access to exclusive loyalty, rewards and offers.

We cannot assure constant availability or uninterrupted access to the Services or the App, nor can we guarantee the continuous availability of any content within them. There may be instances where we need to suspend, withdraw, or limit access to all or certain parts of the Services due to business or operational requirements. Whenever feasible, we will endeavor to provide you with reasonable advance notice of any such suspension or withdrawal.

No part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licenced, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

2.1 Registration

To use the Services, you will be required to sign up for an account through the App. You may sign up using an email and password or by logging in through certain third party sites (such as Apple, Google or Facebook) where you may already have an account. Once you have signed in for the first time, your credentials will be saved and you will be automatically logged in unless you have signed out.

2.1.1 Age of use

To register, earn rewards and redeem offers, you must be 13+ and live in the UK. We may need to see proof of age at any point and reserve the right to verify your age.

2.2 How to earn stamps

By using the App, visiting venues and placing orders for food or any other eligible products, you will accrue stamps to your Maidah account when you spend above the minimum threshold determined by each restaurant. The process for digital stamp collection involves selecting the ‘M’ button within app, and tapping your mobile device onto the Maidah NFC device at the participating restaurant. Loyalty stamps are accumulated per Restaurant location.

2.3. Redeeming Rewards & Offers

Stamps can be redeemed for rewards once reaching a qualifying number of stamps, and can be accessed/ redeemed via the Restaurant specific page in-app. Rewards and offers are subject to change on an ongoing basis and are subject to the conditions of each particular reward or offer. These rewards and offers can also be removed at any point in time without advance notice.

2.3.1 Individual rewards and offers cannot be combined with any other offer or reward at any time.

2.3.2 If you believe that your Stamps balance has not been updated accurately, you must notify us within 24 hours using the ‘Contact us’ section in the App with details and any evidence you may have. Maidah App will use reasonable efforts to verify the stamp balance and if it considers (in it’s sole discretion) that an error has been made, your stamps balance may be amended accordingly.

2.3.3 Loyalty stamps, rewards or any benefits accrued through the App cannot be transferred to any other account or third party whatsoever, nor can they be exchanged for cash or monetary value. One loyalty stamp can be accrued per visit to a restaurant (and this is up to a maximum of one visit per day to that specific restaurant).

2.4 Restaurant Rewards & Offers

From time to time, restaurants may publish offers to users of the App in addition to loyalty stamps and rewards. 

2.4.1 In addition to minimum stamps, rewards & offers may be subject to further conditions. Such conditions may include (but are not limited to) a claim time limit, minimum spend, maximum number of redemptions or minimum qualifying stamps.

2.4.2 If you wish to redeem an offer, you can do so by clicking the ‘Redeem’ button on the particular offer when you’re at a qualifying restaurant. You should approach the restaurant staff to process your order using the offer.

2.4.3 Restaurants are solely responsible for honouring offers they have made through the App. However, if you consider a restaurant has failed to honour an offer made to you, please notify us within 24 hours with any details and/or evidence via the ‘Contact Us’ functionality in-app. Maidah App will use reasonable efforts to remedy the issue (at its sole discretion).

2.4.4 Restaurant and offer images are for illustrative purposes only and may differ from the actual product.

2.5 Functionality

In order to enjoy the full benefit of the Services, Maidah App uses NFC technology  for stamp collection  or rewards offer redemption. 

2.5.1 It is possible that your device is not able to utilise NFC technology effectively and if this is the case, please contact us using the Support function in the App with your device make and model and we will try our best to assist you.

2.5.2 If your device cannot scan the NFC device in participating restaurants, your phone is not working or you have not got your device with you, Maidah is unable to retrospectively add stamps or rewards to your account. Users are responsible for ensuring their device is functioning correctly before attempting to collect a stamp or redeem a reward and in the case of any issues, please notify us within 24 hours with any details and/or evidence so we can assist at our sole discretion.

2.5.3 Maidah App Limited will not be responsible for any device malfunctions or where stamps or rewards cannot be accumulated and redeemed due to a device not working.

2.6 Limitation of use of your Maidah App Account

2.6.1 Maidah App accounts should not be sold, exchanged or used for any other purpose than specified in these Terms, without our written consent.

2.6.2 Maidah App Limited does not warrant or represent that Maidah App stamps, offers or rewards will always be accepted at participating restaurants. For example, in the unlikely event of a failure of IT and communications systems, we may not be able to add stamps or allow you to redeem a reward during such a system failure.

2.6.3 Maidah App Limited reserves the right to refuse or to limit the use of Maidah App if we think your account is suspected to be affected by fraud, misconduct or unauthorised use or any actions that negatively impact the Maidah brand. We can withdraw or cancel your Maidah App account or take any other appropriate action if we suspect fraud, misconduct or unauthorised use. Once cancelled, you won’t be able to redeem any stored rewards. 

  1. User Agreement

3.1. Acceptance: By using the App, users agree to abide by these terms and conditions. Users must also meet any eligibility requirements specified by the App.

  1. User Accounts

4.1. Registration: Users are required to create an account to access certain features of the App. Users are responsible for maintaining the security of their account credentials and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change any user account that, in our sole discretion, has breached these terms and conditions. Only one account may be registered and used by an individual.

4.2. We reserve the right to withdraw Maidah App services on reasonable notice.

4.3 You have the right to cancel your Maidah App account at any time, but you will lose the right to redeem all unused rewards. Get in touch to cancel your account.

  1. Content

5.1. User Content: Users retain ownership rights to any content they upload or create within the App. However, by uploading or creating content, users grant the App a non-exclusive license to use, modify, or distribute that content.

5.2 Where our Site or the App contain links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.

  1. Intellectual Property

6.1. Ownership: The App and its contents, including trademarks, logos, and copyrighted materials, are owned by Maidah App Limited.

  1. Privacy Policy

7.1. Data Collection: Users’ personal data is collected, used, and protected in accordance with the App’s privacy policy. By using the App, users consent to the collection and use of their personal data as outlined in the Privacy Policy.

  1. Prohibited Activities

8.1. Restricted Actions: Users are prohibited from engaging in activities such as spamming, hacking, or any illegal behavior while using the App.

  1. Limitation of Liability

9.1. Disclaimer: The App is provided “as is” without any warranties. Maidah App Limited shall not be liable for any damages arising from the use of the App. In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the services, even if we have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to use for use solely of our Services.

9.2 Your utilisation of the App and the Services entails inherent risks, and you acknowledge and accept that the Services are provided to you on an “as is” and “as available” basis.

9.3. Without limiting the information detailed above, Maidah App disclaims any warranties, representations (excluding fraudulent misrepresentation), guarantees, or conditions to the fullest extent permitted by law, whether expressed or implied.

9.4. Maidah App assumes no responsibility or liability and makes no warranty regarding the completeness, accuracy, availability, functionality, compatibility, absence of defects, timeliness, security, performance, reliability of the Services or any content. Maidah App shall not be held responsible or liable for any damage to your computer system, loss of data, or any other harm arising from your access to or use of the Services or the App. Maidah App does not warrant that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis.

9.5. We do not warrant or represent that the Services are free from viruses or other harmful components. Your use of the Services is at your own discretion and risk, and you will bear sole responsibility for any damage to your computer, mobile device, or network resulting from such use. We shall not be liable for any loss or damage resulting from a distributed denial-of-service attack, viruses, or any other technologically harmful material that may infect your computer equipment, software, data, or other proprietary material due to your use of the Services, or any linked website or application.

9.6. We are not liable for any inability to access the Services at any time, for any reason, including but not limited to planned or unplanned downtime, or network outages (including mobile networks), or when you are not within an area supported by mobile coverage.

  1. Governing Law

10.1. Applicable Law: These terms and conditions are governed by the laws of the United Kingdom.

10.2 These Terms are governed by the laws of England and Wales. This means that your use of your Maidah App account and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims), will be governed by English law. 

  1. Updates and Changes

11.1. Modification: Maidah App Limited reserves the right to update or change these terms and conditions at any time. Users will be notified of any changes by Maidah App Limited updating the ‘Last Updated’ date of these Legal Terms.
